THE QUESTION

I’m in Miami, Florida. My situation is that my boss denied all my sick days request (5 days) in total. And when I ask him what happened and why they were denied he answers me back saying “you cannot request sick days when you’re not sick, you need a proof from the doctor and you have to request them with time ahead”. I’m not feeling as bad to go to the doctor but I still need my days off, and I cannot get a note plus how I’m supposed to request them with time ahead if I don’t know when I’m gonna feel bad. What can I do? Thank y’ll.

TL;DR

Denied sick days are illegal. Document everything, know your rights, and consider filing a formal complaint or speaking to a labor rights organization. Pursue options to address this unfair treatment.

THE RESPONSE

What’s actually going on here

I'm sorry to hear your sick days were denied - that's a really frustrating and unfair situation. Unfortunately, this is a common problem many workers face, as employers often try to push the boundaries of what's legally allowed. The root cause is typically a combination of profit-driven motives and an imbalance of power, where workers are made to feel replaceable. But you do have rights here. The "Reality Audit" chapter in our Workers Rights Playbook outlines how to thoroughly document the situation, including getting written communication from your boss about the denied sick days. This creates a paper trail that will be crucial if you need to escalate things. Next, I'd recommend trying internal resolution by sitting down with your boss and calmly but firmly explaining your legal entitlement to sick leave. Bring printouts of the relevant labor laws. If that doesn't work, the "Enforcement Strategy" framework advises involving HR or a government labor agency to investigate the situation. As a last resort, the guide covers how to consult an employment lawyer. They can assess your case and advise on the best path forward, whether that's negotiating a settlement or taking legal action. I know this all may feel daunting, but having an expert on your side can make a big difference. The key is not to let your employer intimidate you or make you feel powerless. When you stand up for your rights, you're not just helping yourself - you're also contributing to positive change in the workplace. With the right approach, you can get the sick leave you're entitled to and send a clear message that this kind of treatment is unacceptable.
